What is Trademark Renewal?

Under the Trade Marks Act, 1999, a registered trademark is valid for 10 years from the date of application and must be renewed every 10 years to keep it protected. A renewal application (Form TM-R) can be filed within 6 months before expiry.

If you miss the expiry date, the mark can still be renewed within 6 months after expiry on payment of a surcharge. If it is removed from the register for non-renewal, an application for restoration can be filed within one year from the date of expiry. After that, the protection is lost and you may have to apply afresh.

Documents Required for Trademark Renewal

To renew a trademark in India, the following documents are generally required:

  1. Copy of the trademark registration certificate.

  2. Trademark application or registration number.

  3. Identity and address proof of the registered proprietor.

  4. Power of Attorney (Form TM-M) in favour of the agent.

  5. If ownership or address has changed, supporting documents for recording the change.

Renewal can also be combined with changes to the registered proprietor’s name or address. We check your record on the Registry before filing so that the renewed registration is accurate.
