What is Design Registration?
Design registration protects the visual appearance of a product: its shape, configuration, pattern, ornament or composition of lines and colours, when applied to an article by an industrial process. It does not protect how the product works (that is covered by a patent) or brand names (covered by a trademark).
A registered design is protected for 10 years, which can be extended by a further 5 years, a total of 15 years. The design must be new or original and must not have been published or used publicly before filing.
Documents Required for Design Registration
To register a design in India, the following documents are generally required:
Application for registration of design (Form 1).
Representation sheets showing the design from different views (front, back, top, side and perspective).
Statement of novelty and the class of the article under the Locarno classification.
Identity and address proof of the applicant.
Power of Attorney in favour of the agent.
Proof of small-entity or startup status, if claiming reduced fees.
If the application is filed by a company, LLP or firm, the certificate of incorporation, LLP agreement or partnership deed must also be submitted.
