What is a Patent?

A patent is an exclusive right granted by the Government of India for an invention, whether a product or a process. It allows the patent holder to stop others from making, using, selling or importing the invention without permission, for 20 years from the date of filing.

To be patentable, an invention must be new (novel), involve an inventive step (not obvious to an expert), and be capable of industrial application. If your invention is still being developed, you can file a provisional application to secure an early filing date, and then file the complete specification within 12 months.

Documents Required for Patent Registration

To file a patent application in India, the following documents are generally required:

  1. Application for grant of patent (Form 1).

  2. Provisional or complete specification (Form 2) describing the invention, with claims, abstract and drawings.

  3. Statement and undertaking regarding foreign applications (Form 3).

  4. Declaration as to inventorship (Form 5).

  5. Power of Attorney (Form 26) in favour of the patent agent.

  6. Proof of startup or MSME status, where applicable, to claim reduced government fees.

A request for examination (Form 18) must be filed within the prescribed time limit; without it, the application is not examined. Startups and small entities can request expedited examination.
